Los cambios impulsados por la reforma laboral de 2019 han incidido de manera importante en el mapa sindical en el país. Este año, el tema laboral seguirá siendo estratégico en la agenda de las empresas, de ahí la importancia de la preparación de los mandos medios y los líderes de negocio.
Entre el desmedido crecimiento de constancias de representatividad y nuevas titularidades de contratos colectivos de trabajo (CCT), se dibuja una realidad diferente en el mapa sindical de nuestro país.
Terminamos el 2023 con un panorama laboral muy distinto al que traíamos históricamente, lo que nos ha mostrado que en México vivíamos en un “Disneylandia laboral”, donde no sólo teníamos paz, flexibilidad y certeza, sino también pagamos un alto precio en indicadores básicos del empleo, como bajo salario por hora y largas jornadas de trabajo.
Hoy vemos un mapa sindical completamente redistribuido por cuenta de los resultados de las legitimaciones.
Por una parte, las grandes centrales obreras se están fraccionando ante la pérdida de muchos CCT que eran realmente de protección, lo que por años generó que la conquista del trabajador y la defensa de sus necesidades se abandonarán, debilitando las estructuras de representación y alejándose de sus afiliados, quienes se mantenían más por costumbre que por necesidad.
Hoy, frente a la desaparición de más del 82% de los contratos colectivos en México que no fueron legitimados al 1 de mayo de este año, vemos un panorama que dice mucho de las relaciones colectivas:
- Sólo el 12.7% de los trabajadores formales están agrupados en un sindicato. Incluso en los estados de la república con mayor sindicalización como Tamaulipas y Coahuila, el porcentaje de trabajadores afiliados a un sindicato apenas llega a menos del 30 por ciento.
- El crecimiento de más del 44% en la cantidad de solicitudes de constancias de representatividad en 2023 respecto de lo observado en 2022 demuestra una gran actividad de los sindicatos buscando posicionarse nuevamente en la representación de los trabajadores. La CDMX, el Estado de México, Jalisco, Nuevo León y Querétaro cuentan con la mayor cantidad de solicitudes. Entre estos llaman la atención Nuevo León y el Estado de México, que tienen el mayor crecimiento en la tendencia de solicitudes de constancias.
- Llama la atención el alto número de constancias de representatividad en el sector comercio, que tradicionalmente estuvo libre de sindicatos, pues a la fecha representa más del 20% de las constancias solicitadas.
- Todavía impera un ambiente libre de sindicatos, el escenario de mayor blindaje laboral, pues solamente 6.8% de las constancias se han traducido en la formalización de un CCT y con ello la vida sindical activa.
- Los sindicatos independientes siguen avanzando en la conquista de afiliados, y los vemos principalmente en la frontera norte de México y el Bajío. Las banderas de conexión con los trabajadores siguen siendo las mismas, enfocadas en incrementos salariales por arriba del mínimo, ajustes en la jornada laboral y promesas de mayor participación en utilidades o bonos de productividad. Lo diferente de este tipo de sindicalismo tiene que ver más con la forma de comunicación hacia los trabajadores, con mayor uso de redes sociales y discursos más radicales. También llama la atención que estos sindicatos han basado mucha de su estrategia en el uso del Mecanismo Laboral de Respuesta Rápida, consignado en el T-MEC, con lo que han logrado sus victorias, en varios casos ya conocidos.
- Por último, y aún en desarrollo, el crecimiento de la participación de los sindicatos minoritarios empieza a generar mucha mayor incertidumbre en el campo laboral, esto por cuenta de amparos y procesos jurídicos que les han dado derechos proporcionales sobre las cuotas obreras, los permisos sindicales y más adelante seguramente la propia negociación colectiva.
Frente a este panorama, que aún sigue cambiando y consolidándose, necesitamos contar con un sólido plan de transformación laboral que apoye a la empresa en el cambio de su cultura operativa diaria, mitigando riesgos y evitando generar banderas de conflictividad.
Para ello, el trabajo debe estar enfocado en habilitar a los mandos medios y líderes del negocio en las prácticas y comportamientos que permitan una mejor conexión con los colaboradores.
Finalmente, también debe contemplar un monitoreo continuo de riesgos internos y externos que deje claros los protocolos con los que se debe responder a la aparición de algún síntoma.
El tema laboral seguirá siendo estratégico en la agenda de las empresas, por ello la preparación de los responsables y sus equipos continuará siendo fundamental.
